These Terms govern your access to and use of the Blekota educational software-as-a-service (“Service”). By creating an account or using the Service you agree to these Terms.
1. Eligibility & Accounts
The Service is intended for anyone. However, you must be legally capable of entering into a contract in your jurisdiction. If you are under the age at which you can consent to data processing on your own (e.g. 16 under GDPR), a parent/guardian or your school must consent on your behalf.
You register using email (via Firebase/Google OAuth). Keep your credentials secure; you are responsible for all activity under your account.
2. Acceptable Use
You agree not to:
Break the law or infringe third‑party rights.
Upload or generate violent, hateful, or otherwise harmful content.
Probe, scan or test the vulnerability of the Service, scrape or harvest data, or reverse engineer the code except where permitted by law.
Interfere with other users’ access or the security and integrity of our systems.
We may suspend or terminate accounts that violate these rules.
3. Plans, Trials & Payments
Freemium model: a free tier plus paid plans. A 7‑day free trial applies to new paid subscriptions.
No refund policy: Payments are non‑refundable except where required by applicable law.
Prices and features may change. We will notify you as described in Section 10.
4. Intellectual Property
Our IP: All software, code, designs, and brand assets (including “Blekota”) are owned by us. You receive a limited, non-exclusive, non-transferable license to use the Service as provided.
Your Input & Data: By submitting content or data to the Service, you grant us a worldwide, royalty‑free license to store, process, analyze and use it (in raw or anonymized/aggregated form) to operate, maintain, and improve the Service and our AI/context models. You must have the rights to everything you upload.
5. Service Availability & Changes
We aim to keep the Service running smoothly but do not guarantee uninterrupted availability. Features may be added, changed or removed.
6. Third‑Party Services
We use third parties for hosting (Vercel), authentication (Google/Firebase), and analytics (PostHog, Google Analytics). Their terms may apply when you interact with them.
7. Termination
You may stop using the Service at any time. We may terminate or suspend access for violations of these Terms or if we discontinue the Service. Upon termination, sections that by nature should survive (e.g., IP, disclaimers, liability, governing law) do survive.
8. Disclaimers & Liability
The Service is provided "as is" and "as available" without warranties of any kind, except as required by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim (or EUR 0 if you only used the free plan).
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Czech Republic and applicable EU law. Courts of the Czech Republic (generally Prague) shall have exclusive jurisdiction, unless mandatory law provides otherwise.
10. Changes to These Terms
We will notify you of material changes via in‑app notice and email at least 30 days before they take effect. Continued use after the effective date means you accept the new Terms.
